Do I have to give a reference?
No, there is no legal duty to provide one. If you do, it should be accurate and fair, because both the tenant and the recipient may rely on it.
What should I leave out?
Anything your records cannot support, and anything unrelated to the tenancy such as health or benefit status. Facts about dates, rent and condition are what referencing needs.
Do I need the tenant’s consent?
You should have it. Most referencing requests are made at the tenant’s request and include their consent. Keep a copy with your records, as UK data protection law expects.
